The GDPR is a new data protection regulation which will be in place from 25th May 2018.  It will replace the current Data Protection Act 1998 and sit alongside a new Data Protection Act (currently a bill).  The 2 pieces of legislation will need to be considered together to ensure compliance with legislation.

 

Whilst the GDPR has many similarities to the DPA, it sets out to modernise current legislation.  There are some significant changes relating to the rights individuals have over the use of their personal information.  Organisations need to show compliance through policies, procedures and staff training but also need to be able to demonstrate governance and accountability at Board level to show a commitment to the way the organisation protects, governs and understands its data processing.

 

A failure to prepare could have serious consequences for Schools as fines can be imposed for breaches of any aspect of the legislation (not just security breaches) and maximum fines could reach 4% of the organisation’s annual turnover.
